MINUTES OF THE AD HOC MEETING

General Counsel Rolayne Ailts Wiest called the meeting to order. Present were Commissioner Laska Schoenfelder, Executive Director Bill Bullard, Deputy Director Sue Cichos, Staff Attorney Karen Cremer, Utility Analysts Bob Knadle, Kylie Tracy, and Michele Farris, Consumer Representative Leni Healy, and Administrative Secretary Shirleen Fugitt.

Also present were Bob Riter representing FirsTel and Lori Grode, Pierre Court Reporting.

Joining the meeting by phone were Chairman Jim Burg; Vice-Chair Pam Nelson; Neil Schmid, FirsTel; Colleen Sevold, Todd Lundy and Tom Welk, U S WEST; and Todd Epp, Basec.Net.

Telecommunications

1. TC98-194 IN THE MATTER OF THE COMPLAINT FILED BY BASEC.NET, HURON, SOUTH DAKOTA, AGAINST U S WEST COMMUNICATIONS AND FIRSTEL, INC. REGARDING BILLING ISSUES. (Consumer Representative: Leni Healy. Staff Attorney: Karen Cremer.)

The parties presented their arguments on Basec.Net's request for expedited response time and U S WEST's motions for continuance of the hearing or, in the alternative, for a protective order, and to strike requests for irrelevant and proprietary information. Ms. Wiest recommended denial of Basec.Net's request for expedited response time. She further recommended granting U S WEST's motion for continuance. And, lastly, she recommended denial of U S WEST's motion to strike requests for irrelevant and proprietary information and that the parties be instructed to work out a protective order.

Chairman Burg moved to deny Basec.Net's request for expedited response time, to grant U S WEST's motion for continuance and to deny U S WEST's motion to strike requests for irrelevant and proprietary information and that the parties be instructed to work out a protective order. Commissioner Schoenfelder seconded and Commissioner Nelson concurred. Motion passed 3-0.

The meeting was adjourned.
