Administration

1.     AA16-001     Establishment of the Gross Receipts Tax Levy for the 2017 Fiscal Year (Finance Manager: Cindy Kemnitz)

SDCL Chapter 49-1A establishes the South Dakota Public Utilities Commission Gross Receipts Tax Fund. This Fund is financed by assessing a tax on the annual intrastate gross receipts received by a utility. The Fund is used by the Commission to defray regulatory expenses related to the regulation of telecommunications, electricity and natural gas. On April 1 of each year, all utilities and telecommunications companies doing business in South Dakota shall file with the Commission, on forms provided by the Commission, the amount of its gross receipts derived from customers within South Dakota during the preceding calendar year pursuant to SDCL 49-1A-4. The report shall be sworn to and verified by an officer of the company. The Commission shall, by order, establish the rate and assess the tax authorized in SDCL 49-1A-3 which, together with any funds remaining from the current fiscal year and the two hundred fifty dollar minimum gross receipt tax, will fund the Commission’s budget for the next fiscal year and provide a contingency reserve in an amount not to exceed the prior year’s budget. In accordance with SDCL 49-1A-5, the tax is due and payable on July 15 of each year. On April 8, 2016, staff filed a letter requesting a docket be opened in this matter and to also set the rate at .00135 or $250 per company, whichever is greater.

     TODAY, shall the Commission Establish the Rate and Assess the Gross Receipts Tax as Authorized in SDCL49-1A-3?

1.     EL16-009    In the Matter of the Filing of Northern States Power Company dba Xcel Energy for Approval of its 2015 Economic Development Activities and 2016 Budget (Staff Analyst: Darren Kearney; Staff Attorney: Kristen Edwards)

On March 9, 2016, Northern States Power Company dba Xcel Energy (Xcel) filed for approval of its 2015 Economic Development Annual Report and 2016 Economic Development Budget. The filing included Xcel's report on the 2015 budgeted and actual economic development expenses and provided documentation of the actual expenses incurred. The filing also included a proposed economic development budget for 2016. On March 30, 2016, Xcel filed its responses to staff's data request.

     TODAY, shall the Commission approve Xcel Energy's 2015 Economic Development Report and its 2016 Economic Development Budget?

2.     EL16-013    In the Matter of the Petition for Electrical Service by Dakota Plains Ag Center, LLC to have NorthWestern Energy Assigned as its Electric Provider in the Service Area of Bon Homme Yankton Electric Assocation Inc. (Staff Analysts: Patrick Steffensen, Eric Paulson; Staff Attorney: Kristen Edwards)

On April 1, 2016, the Commission received a petition from Dakota Plains Ag Center, LLC (Dakota Plains) for a service territory exception pursuant to SDCL 49-34A-56. Dakota Plains requests authorization to take electric service from NorthWestern Energy. Dakota Plains states it would be a new customer within the territory of Bon Homme – Yankton Electric Cooperative Inc.

     TODAY, shall the Commission grant intervention to any parties that may have filed?

3.     EL16-014    In the Matter of the Petition for Temporary Electrical Service by Dakota Plains Ag Center, LLC to have NorthWestern Energy Assigned as its Electric Provider in the Service Area of Bon Homme Yankton Electric Assocation Inc. (Staff Analysts: Patrick Steffensen, Eric Paulson; Staff Attorney: Kristen Edwards)

On April 1, 2016, the Commission received a petition from Dakota Plains Ag Center, LLC (Dakota Plains) for temporary electric service pursuant to SDCL 49-34A-56 and 49-34A-58. Dakota Plains requests authorization to take temporary electric service from NorthWestern Energy (NorthWestern). Dakota Plains states NorthWestern has facilities in place alongside the location and is ready, willing, and able to provide electric service to Dakota Plains during the construction stage of the project.

     TODAY, shall the Commission grant intervention to any parties that may have filed?

  1. Commissioners will attend the Central Electric Cooperative Annual Meeting, Tuesday, April 5, 2016, at 7:30 p.m. CDT at the Corn Palace, Mitchell, S.D.

  2. The next regularly scheduled commission meeting will be Wednesday, April 27, 2016, at 9:30 a.m. CDT in Room 413 at the State Capitol, Pierre, S.D.

  3. Commissioners and staff will attend NIST Cybersecurity Framework Training May 3-4, 2016, at the Holiday Inn City Centre, Sioux Falls, S.D.

  4. Commission meetings are scheduled for May 10 and 24, 2016.
