Electric

1.     EL13-020     In the Matter of the Application of Northern States Power Company dba Xcel Energy and Otter Tail Power Company for a Permit to Construct the Big Stone South to Brookings County 345 kV Transmission Line (Staff Analysts: Brian Rounds, Darren Kearney; Staff Attorney: Karen Cremer)

On June 3, 2013, the Commission received an application from Northern States Power Company d/b/a Xcel Energy and Otter Tail Power Company for a permit to construct the southern portion of the Big Stone South to Brookings County Substation 345 kV transmission line in Deuel and Brookings Counties and make modifications to the existing Brookings County Substation. On July 31, 2013, Applications for Party Status were filed by the Brookings County Commission and Basin Electric Power Cooperative. On August 5, 2013, an Application for Party Status dated August 1, 2013, was filed by Dakota Rural Action. On July 31, 2013, the Commission held a public input meeting in Brookings. On August 13, 2013, the Commission granted party status to the Brookings County Commission, Basin Electric, and Dakota Rural Action. On February 7, 2014, Applicants filed a Motion for Approval of Settlement Stipulation and a Settlement Stipulation.

     TODAY, shall the Commission grant the Motion for Approval of Settlement Stipulation and approve the terms and conditions stipulated therein?

2.     EL13-029     In the Matter of the Petition of Otter Tail Power Company for Approval of its 2014 Transmission Cost Recovery Eligibility and Rate Adjustment (Staff Analysts: Brittany Mehlhaff, Patrick Steffensen; Staff Attorney: Karen Cremer)

On August 30, 2013, Otter Tail Power Company (OTP) filed a petition for approval of its 2014 Transmission Cost Recovery (TCR) Rider. The update includes the tracker balance estimated for the end of the current recovery period so that no over or under-recovery of TCR costs occurs. The update also includes the costs of one new transmission project that is not currently in base rates and has not previously been approved for inclusion in the TCR Rider. OTP's petition proposed a January 1, 2014, effective date. On February 10, 2014, a Joint Motion for Approval of Settlement Stipulation and Settlement Stipulation were filed with the Commission, with a proposed effective date for the revised TCR rate of March 1, 2014.103

     TODAY, shall the Commission grant the Joint Motion for Approval of the Settlement Stipulation and approve the rates, terms and conditions stipulated therein?

3.     EL13-043     In the Matter of the Request for Approval of an Electric Service Territory Boundary Agreement between Central Electric Cooperative, Inc. and Northern States Power Company d/b/a Xcel Energy. (Staff Analyst: David Henry; Staff Attorney: Kristen Edwards)

On December 30, 2013, Commission Staff filed an Electric Service Territory Boundary Agreement between Central Electric Cooperative, Inc. and Northern States Power Company d/b/a Xcel Energy. This filing is made pursuant to current efforts of the PUC to verify electric territory mapping data for conversion to electronic format and use in a Geographic Information System (GIS) database. With the assistance of the above-referenced utilities, Commission Staff has confirmed the service territory boundary shared by these utilities and has prepared updated mapping information. Commission Staff asks for approval of the agreement to update official mapping data to properly reflect the service territory boundaries shared by the utilities in this docket.

With the assistance of the above-referenced utilities, Commission Staff has confirmed the service territory boundary shared by these utilities and has prepared updated mapping information. On January 6, 2014, Commission Staff filed an Electric Service Territory Boundary Agreement between Sioux Valley Energy Electric Cooperative, Inc. and Volga Municipal Electric. This filing is made pursuant to current efforts of the PUC to verify electric territory mapping data for conversion to electronic format and use in a Geographic Information System (GIS) database. With the assistance of the above-referenced utilities, Commission Staff has confirmed the service territory boundary shared by these utilities and has prepared updated mapping information. Commission Staff asks for approval of the agreement to update official mapping data to properly reflect the service territory boundaries shared by the utilities in this docket.

7.     EL14-005     In the Matter of the Joint Request for Service Rights Exception between Black Hills Power, Inc. and Black Hills Electric Cooperative, Inc. (Staff Analyst: David Henry; Staff Attorney: Kristen Edwards)

On January 9, 2014, Black Hills Power (BHP) submitted a Service Territory Exception Agreement between Black Hills Power and Black Hills Electric Cooperative (BHEC). The proposed exception to the existing service territory boundary will permit BHP to provide service to a shop, located in BHEC service territory. BHP currently provides power to a house in the same location. 

     TODAY, shall the Commission approve the requested service rights exception and Service Territory Exception Agreement?

8.     EL14-006     In the Matter of the Filing by Otter Tail Power Company for Approval of Petition of Tariff Revisions to its Rates for Small Power Production and Cogeneration (Staff Analyst: Eric Paulson; Staff Attorney: Karen Cremer)

On January 14, 2014, the Commission received an application from Otter Tail Power Company (Otter Tail). This filing proposes updates to Otter Tail's Small Power Producer Riders, Sections 12.01, 12.02 and 12.03. In the listed sections Otter Tail proposes to update the energy and capacity payments as well as the renewable energy credit values. These payments are made to qualifying facilities within the Otter Tail service area. Otter Tail is requesting a March 1, 2014, effective date for bills rendered on and after that date.

     TODAY, shall the Commission approve the proposed revisions to Otter Tail Power Company's rates for Small Power Production and Cogeneration for Qualifying Facilities?

Telecommunications

1.     TC13-110     In the Matter of the Filing by IntelePeer, Inc. for Approval of Revisions to its Access Service Tariff No. 1 (Staff Analyst: Eric Paulson; Staff Attorney: Karen Cremer)

On September 5, 2013, the Commission received an application from IntelePeer, Inc. (IntelePeer). This filing proposes to modify its switched access tariff. On September 25, 2013, and January 31, 2014, IntelePeer responded to Staff's data requests

TODAY, shall the Commission approve the proposed tariff revisions?

2.     TC13-137     In the Matter of the Filing by Broadvox-CLEC, LLC for Approval of Revisions to Tariff No. 1 (Staff Analyst: Eric Paulson; Staff Attorney: Karen Cremer)

On December 3, 2013, the Commission received an application from Broadvox-CLEC, LLC (Broadvox). This filing proposes to modify language in its switched access tariff. On December 20, 2013, AT&T Corp. filed a petition to intervene and requested to suspend the tariff and investigate. On January 24, 2014, Broadvox filed a response to the petition to intervene. On January 27, 2014, the Commission granted AT&T intervention and suspended the tariff until March 4, 2014. On February 7, 2014, Broadvox filed revised tariff pages.
        
     TODAY, shall the Commission approve the proposed tariff revisions with a February 20, 2014, effective date?

  1. The PUC offices will be closed Monday, February 17, 2014, in observance of the Presidents' Day holiday.

  2. PUC Commissioners will attend the South Dakota State Federation of Labor Legislative Conference on Thursday, February 20, 2014, at 1 p.m. CST at the ClubHouse Hotel & Suites, Pierre, S.D.

  3. A hearing in docket TC11-087 will be held February 24-26, 2014, beginning at 9:00 a.m. CST February 24 in the South Dakota Education Association auditorium, 411 E. Capitol Ave., Pierre, S.D.

  4. The next regularly scheduled commission meeting will be Tuesday, March 4, 2014, at 2:30 p.m. CST in Room 414 at the State Capitol Building, Pierre, S.D.

  5. The PUC will have an exhibit booth at the Sioux Empire Home Show, March 7-9, 2014, at the Sioux Falls Convention Center, Sioux Falls, S.D.

  6. Commissioners will attend the Center for Public Utilities Advisory Council's Current Issues 2014 forum March 9-12, 2014, at the Eldorado Hotel, Santa Fe, N.M.

  7. Commission meetings are scheduled for March 18 and April 1, 2014.
