Consumer Issues

1. IN THE MATTER OF DISMISSING COMPLAINTS CT00-100 and CT00-105.

CT00-100 IN THE MATTER OF THE COMPLAINT FILED BY EARL A. ELIASON ON BEHALF OF EARL'S BARBER SHOP, PHILIP, SOUTH DAKOTA, AGAINST AT&T COMMUNICATIONS OF THE MIDWEST, INC. REGARDING UNAUTHORIZED SWITCHING OF SERVICES. (Staff Analyst: Charlene Lund. Staff Attorney: Karen Cremer.)

The complainant alleges that his long distance services were switched without his authorization and he has received billings and charges which he disputes. He reports that he has requested a copy of the verification tape and this has not been provided.

CT00-105 IN THE MATTER OF THE COMPLAINT FILED BY ARNOLD DEUTSCH ON BEHALF OF DEUTSCH CONSTRUCTION, INC., SISSETON, SOUTH DAKOTA, AGAINST QWEST CORPORATION REGARDING UNAUTHORIZED SWITCHING OF SERVICES. (Staff Analyst: Leni Healy. Staff Attorney: Karen Cremer.)

The Complainant claims that his service was switched without authorization. The Respondent has not provided written authorization or taped verification. The Complainant requests crediting the account of all charges plus a penalty.

TODAY, if the above matters are resolved shall the Commission dismiss the complaints and close the dockets?

2. CT00-090 IN THE MATTER OF THE COMPLAINT FILED BY ED AND JANICE ST. GEMME, DAKOTA DUNES, SOUTH DAKOTA, AGAINST AT&T COMMUNICATIONS OF THE MIDWEST, INC., REGARDING UNAUTHORIZED SWITCHING OF SERVICES. (Staff Analyst: Leni Healy. Staff Attorney: Karen Cremer.)

The Complainants claim that they did not authorize a switch in service. They received billings from AT&T although AT&T claims that the St. Gemme family is not a customer of AT&T. The Complainants are seeking a final resolution to this issue. On September 13, 2000, the Commission added Qwest as a party. On August 14, 2000, AT&T filed a Motion to Dismiss. After the agenda was issued, on October 10, 2000, Qwest filed a Motion to Dismiss with the Commission. A hearing is scheduled for November 2, 2000.

Telecommunications

1. TC99-120 IN THE MATTER OF THE APPLICATION OF ARRIVAL COMMUNICATIONS, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES, INCLUDING LOCAL EXCHANGE SERVICES, IN SOUTH DAKOTA. (Staff Analyst: Michele Farris. Staff Attorney: Karen Cremer.)

On December 22, 1999, Arrival Communications, Inc. filed a request for a Certificate of Authority to operate as a provider of resold and facilities-based local exchange and interexchange telecommunications services in South Dakota. Arrival Communications will focus on the provision of digital subscriber line and other advanced services to residential and business customers. Arrival may also provide local dial tone, switched access, and interexchange services. On January 18, 2000, the Commission granted intervention to SDITC.

TODAY, shall the Commission grant a Certificate of Authority to Arrival Communications, Inc.?

2. TC00-125 IN THE MATTER OF THE APPLICATION OF TELERA COMMUNICATIONS, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES, INCLUDING LOCAL EXCHANGE SERVICES, IN SOUTH DAKOTA. (Staff Analyst: Keith Senger.)

Telera Communications, Inc. is seeking a Certificate of Authority to provide interexchange and local exchange telecommunication services in South Dakota. The applicant intends to provide specific forms of intrastate local exchange and interexchange telecommunications services targeted primarily at business customers. Services include: 1) switched local exchange services including carrier access and 2) interexchange (switched and dedicated) services including 1+ and 101XXXX outbound dialing, Toll-Free inbound dialing and data services. The applicant does not seek to provide resold or facilities-based local exchange service in the territory of rural telephone companies.

TODAY, shall the Commission grant a Certificate of Authority to Telera Communications, Inc.?

3. TC00-138 IN THE MATTER OF THE APPLICATION OF T-NETIX INTERNET SERVICES, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Keith Senger.)

T-NETIX Internet Services, Inc. is seeking a Certificate of Authority to provide interexchange telecommunication services in South Dakota. The applicant is a reseller that intends to offer interexchange services including 1+ and 101XXXX outbound dialing, toll free inbound dialing, directory assistance, data services and travel card services.

TODAY, shall the Commission grant a Certificate of Authority to T-NETIX Internet Services, Inc.?
