1. Status Report On Consumer Utility Inquiries And Complaints Recently Received By The Commission. (Consumer Representative: Leni Hook.)

The Commission has received 603 consumer contacts during 1996. 116 contacts have been recorded since the June 12,1996 Commission meeting.

TELECOMMUNICATIONS: 86 contacts concerning telecommunications issues have been received since the last meeting. 13 complaints involved the unauthorized switching of long distance service; 13 were classified as "other", 9 contacts involved billing issues; 8 consumers did not receive service when requested; 8 contacts concerned land development fees; 8 contacts involved rates; 6 concerns involved telemarketers; 4 complaints involved charges for 900 number calls; 3 contacts involved excess construction charges; 3 contacts concerned service improvements; 2 contacts involved repair issues; 1 contact involved a cellular problem; 1 issue involved directory listings; 1 contact concerned the sale of exchanges; 1 contact involved Caller ID; 1 contact concerned transfer of service; 1 issue was disconnection; 1 contact involved extended area service requests; 1 concerned a deposit demand.

ELECTRICITY: 14 complaints involving electricity were reported. 4 contacts involved disconnections; 3 concerned billing issues; 3 were classified as "other," and territory issues, excess construction charges, a request for service, and a rude employee were the remaining complaints.

GAS: 10 complaints involving natural gas were reported. 6 complaints concerned disconnections; 2 contacts involved billing issues; 1 contact involved a deposit; and 1 contact was classified as "other."

A total of 355 complaints have been resolved informally during 1996.

Electricity

1. EL96-005 IN THE MATTER OF THE FILING BY THE CITY OF SIOUX FALLS ELECTRIC UTILITY AND NORTHERN STATES POWER COMPANY FOR APPROVAL OF A JOINT REQUEST FOR ELECTRIC SERVICE TERRITORY EXCEPTION. (Staff Engineer: Martin Bettmann. Staff Attorney: Camron Hoseck.)

On June 12, 1996, the Commission received an amended filing of an original filing first received on May 6, 1996, for a Joint Request for Electric Service Territory Exception from the City of Sioux Falls Electric Utility (City) and Northern States Power Company (NSP). The joint request for an exception to the existing electric service territorial agreement would provide NSP the authority to provide electric service to all of the property known as "Hidden Meadows Manufactured Home Park," Phase I, II, and III, and land that could possibly be future development that lies adjacent to and east of the "Hidden Meadows" property. In exchange for the above, the City will take over and maintain a specified number of street lights at various locations within the City corporate limits. These street lights are currently owned and maintained by NSP. A letter in support of the joint request was submitted by Hidden Meadows, L.L.C. on June 27, 1996.

2. EL96-010 IN THE MATTER OF THE FILING BY MONTANA-DAKOTA UTILITIES CO. FOR APPROVAL TO REVISE ITS COGENERATION RATES. (Staff Analyst: Tammi Hendrix. Staff Attorney: Camron Hoseck.)

On June 2, 1996, the Commission received a filing by Montana-Dakota Utilities Co. (MDU) for approval to revise its Occasional Power Purchase Non-Time Differentiated Rate 95, Short-Term Power Purchase Time Differentiated Rate 96 and Long-Term Power Purchase Time Differentiated Rate 97. According to the filing, the proposed rate changes will not affect any customers since no customers are presently served on any of MDU's cogeneration or small power production rates in South Dakota.

3. EL96-015 IN THE MATTER OF THE FILING BY MIDAMERICAN ENERGY COMPANY FOR TARIFF REVISIONS. (Staff Analyst: Bob Knadle. Legal Intern: Adam Reeves.)

On June 21, 1996, the Commission received a filing by MidAmerican Energy Company (MidAmerican) to revise certain electric tariff sheets. According to MidAmerican's filing, these revisions are needed to allow the company to bill temporary services under either residential or small general service rate, whichever is appropriate.

4. EL96-016 IN THE MATTER OF THE FILING BY INTERCOUNTY ELECTRIC ASSOCIATION, INC. REGARDING A SERVICE TERRITORY AGREEMENT. (Staff Engineer: Martin Bettmann. Legal Intern: Adam Reeves.)

On June 19, 1996, the Commission received a filing by Intercounty Electric Association, Inc. (Intercounty) for approval of a Consent and Agreement for Electric Service in Assigned Service Area of Another Electric Utility (Agreement). The purpose of the Agreement is to accommodate a customer who has requested service to an irrigation well located just within NWPS territory. The site of the well is more assessable to Intercounty than to NWPS. NWPS has consented, and Intercounty and the customer have agreed that Intercounty should provide electric services to the site provided the Commission approve the Agreement.

Telecommunications

1. TC95-087 IN THE MATTER OF THE APPLICATION OF DAKOTA TELECOMMUNICATIONS SYSTEMS, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Harlan Best. Staff Attorney: Camron Hoseck.)

In its Order dated June 26, 1996, the Commission set a hearing date of July 31 through August 2, 1996, in this docket. On July 3, 1996, the Commission received a motion from U S WEST Communications, Inc. (U S WEST), an intervenor in this docket, asking permission to serve its first set of interrogatories and document requests on Dakota Telecommunications Systems, Inc. and to expedite discovery.

On January 24, 1996, the Commission received an application from Conetco Corporation d/b/a Communications Network Corporation (CNC) for a Certificate of Authority to operate as a telecommunications company within the state of South Dakota. CNC proposes to resell outbound direct dialed (1+), inbound 800 and travel card services. In response to Staff's data request, CNC requested that consideration of this docket be postponed pending the company's filing of its audited year end 1995 financial statements. At its regularly scheduled meeting of April 2, 1996, the Commission deferred action in this matter. No interventions have been filed.

In its Order dated June 26, 1996, the Commission set a hearing date of July 31 through August 2, 1996, in this docket. On July 1, 1996, the Commission received a motion from U S WEST Communications, Inc. (U S WEST), an intervenor in this docket, asking permission to serve its first set of interrogatories and document requests on AT&T Communications of the Midwest, Inc. (AT&T) and to expedite discovery.

4. TC96-043 IN THE MATTER OF THE COMPLAINT FILED BY ACE AND JILL FOSTER, BELLE FOURCHE, SOUTH DAKOTA, AGAINST U S WEST COMMUNICATIONS, INC. REGARDING HOOKUP FEES. (Staff Analyst Greg Rislov. Staff Attorney: Camron Hoseck.)

On March 7, 1996, the Commission received a complaint filed by Ace and Jill Foster, Belle Fourche, South Dakota (Complainants) against U S WEST Communications, Inc. (U S WEST). Complainant Ace Foster states in his complaint: "I don't believe $744 is a justifiable cost for the materials and small amount of labor it took to install phone service for our home." I ask that the PUC grant the following relief. "U S WEST should refund the $744 development fee and we should only pay their quoted original hook-up fee of $36.45 which has already been billed and paid." A regularly scheduled meeting of March 12, 1996, the Commission made a finding of probable cause but postponed action in this complaint pending a final decision in the related matter TC95-100 et al. On July 1, 1996, the Commission received notice from U S WEST indicating that it had refunded Complainants the amount of $744.00.

5. TC96-044 IN THE MATTER OF THE APPLICATION OF PRIMUS TELECOMMUNICATIONS, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE TELECOMMUNICATIONS SERVICES IN SOUTH DAKOTA. (Staff Analyst: Harlan Best. Staff Attorney: Camron Hoseck.)

On March 8, 1996, the Commission received an application from Primus Telecommunications, Inc. (Primus) for a Certificate of Authority to operate as a telecommunications company within the state of South Dakota. Primus proposes to provide 24-hour intrastate interexchange telecommunications services, and postpaid and prepaid debit travel card services to subscribers.

On June 4, 1996, the Commission received an application from Dial & Save of South Dakota, Inc. d/b/a Dial & Save to amend its Certificate of Authority to provide local exchange service. According to its application: "Dial & Save proposes to provide resold local exchange service to subscribers from all points within the State of South Dakota and, therefore, seeks statewide authorization. Specifically, Dial & Save seeks authority to resell local exchange service in the existing service areas of U S WEST....The specific manner in which Dial & Save will provide local exchange service depends upon the result of negotiations with the incumbent local exchange carriers currently operating within the State." The South Dakota Independent Telephone Coalition, Inc. (SDITC) filed a timely Petition to Intervene in this docket.

20. TC96-099 IN THE MATTER OF THE APPLICATION OF EXCEL TELECOMMUNICATIONS, INC. FOR A CERTIFICATE OF AUTHORITY TO PROVIDE LOCAL EXCHANGE RESALE SERVICES IN SOUTH DAKOTA. (Staff Analyst: Harlan Best. Staff Attorney: Camron Hoseck.)

On June 19, 1996, the Commission received an application from Excel Telecommunications, Inc. (Excel) to amend its Certificate of Authority to provide local exchange service. According to its application: "Excel intends to provide local exchange service on a resale basis. The specific manner in which Excel will provide local exchange service depends upon the result of negotiations with the incumbent local exchange carriers currently operating within the State....Specifically, Excel seeks authority to resell local exchange service in the existing service areas of U S WEST and any other relevant carriers....In light of Excel's extensive experience in providing telecommunications services in the State and its intent to provide nonfacilities-based services only, Applicant requests that a certificate be granted without hearing or any other formal proceeding that would delay its expansion into the local resale market." An intervention deadline of July 5, 1996, has been established. The South Dakota Independent Telephone Coalition, Inc. (SDITC), Dakota Cooperative Telecommunications, Inc. (DCT), and U S WEST Communications, Inc. (U S WEST) have each filed a petition to intervene in this docket.

On June 20, 1996, U S WEST Communications filed an application to add clarifying language related to two- and four-party service to its Exchange and Network Services Tariff. Language has been added to indicate that as facilities are made available, customers must convert to one-party service. USWC committed to spending several million dollars to upgrade all customers to one-party service as part of the investment plan in TC94-121.

On June 20, 1996, U S WEST Communications filed tariffs deleting references to the 55 exchanges that have been sold by USWC. The transfer of these properties occurred on June 22, 1996. This filing revised pages from USWC's Exchange and Network Services Tariff and its Exchange and Network Services Catalog.

32. IN THE MATTER OF THE FAILURE OF CERTAIN TELECOMMUNICATIONS COMPANIES TO FILE AN ANNUAL REPORT AS REQUIRED BY ARSD 20:10:24:04. (Staff Analyst: Harlan Best. Staff Attorney: Adam Reeves.)

In accordance with the Certificate of Authority issued by this Commission when authorizing the operation of a telecommunications company within South Dakota, such authorized companies are required to comport to Administrative Rule 20:10:24:04 which requires that each company submit the following information by May 1 of each year from the preceding calendar year:

(1) A report on its revenues resulting from operations in this state, a current financial statement, and a statement of any changes in the financial position of the telecommunications company relating to operations of the company in South Dakota. The report and statements shall be verified by a corporate officer and shall identify the location where any working papers supporting the report and statements can be reviewed;

(2) A report identifying the exchanges, routes, or other geographic areas of this state where it is providing or expects to provide services. The reports shall include the number and type of customers being served, if the company keeps such records.
