COMPLAINT

CN09-002       In the Matter of the Complaint filed by Mark Pyle/A Plus Towing and Repair, Sioux Falls, South Dakota, against MidAmerican Energy Company Regarding a Billing Dispute.

         On December 22, 2009, A Plus Towing of Sioux Falls, S.D., filed a complaint against MidAmerican Energy.  A Plus Towing states they received a bill for over $7,500 from MidAmerican Energy due to a natural gas meter error.  A Plus Towing asks the Commission to find MidAmerican Energy responsible for accurate meter readings and as a result not hold the consumer responsible for the entire amount of natural gas not properly billed.

ELECTRIC

EL09-025        In the Matter of the Application by Montana-Dakota Utilities Co. for Authority for Deferred Accounting.

            On December 17, 2009, Montana-Dakota Utilities Co. filed an application for authority for deferred accounting for costs related to Montana-Dakota's efforts in securing needed new electric generation to meet the needs of its customers, primarily the Big Stone II Generating Station, until disposition of its next general electric rate case. Absent deferred accounting, the expenditures associated with the electric generation development activity would be required to be recorded as an expense rather than capitalized as an asset now that the Big Stone II project has been discontinued. Deferred accounting will allow capitalization of the development costs until addressed in the next general electric rate case.

EL09-026        In the Matter of the Filing by Otter Tail Corporation d/b/a Otter Tail Power Company for Approval to Update its Rates for Small Power Production and Cogeneration.

            On December 18, 2009, Otter Tail Corporation d/b/a Otter Tail Power Company filed an application to update the customer charges, the energy and capacity payments, introduce Renewable Energy Credits, and update the terms and conditions in the Small Power Producer Rider-Occasional Delivery Energy Service, Small Power Producer Rider-Time Of Delivery Energy Service, and Small Power Producer Rider-Dependable Service rate schedules.  The Company has requested an effective date of February 1, 2010, for the proposed modifications to the rate schedules

EL09-027        In the Matter of the Filing by NorthWestern Corporation d/b/a NorthWestern Energy for Approval of a Contract with Deviations.

            On December 23, 2009, NorthWestern Energy filed an application for approval of a Contract with Deviation to upgrade a single-phase line to a three-phase line to adequately meet the needs of David Melius, 36106 – 151st Street, Cresbard, SD 57435.  This project is necessary to service the multiple grain bins Mr. Melius plans to construct this winter.

PS09-006        In the Matter of Pipeline Safety Enforcement against Montana-Dakota Utilities, Co.
           
      On December 21, 2009, PUC pipeline safety staff filed a docket for Commission approval of penalties it believes should be levied against Montana-Dakota Utilities Co. for violations of the federal pipeline safety code.

TC09-102        In the Matter for the Approval of Amendment to an Interconnection Agreement between Qwest Corporation and Sprint Communications L.P. 

            On December 18, 2009, the Commission received a filing for approval of an Amendment to an Interconnection Agreement between Qwest Corporation and Sprint Communications L.P.  Any party wishing to comment on the Agreement may do so by filing written comments with the Commission and the parties to the Agreement no later than January 7, 2010.  Parties to the Agreement may file written responses to the comments no later than twenty days after service of the initial comments.
